If it is Smith or Smith Virus, those shades without ear piece are correct. He gave his ear piece to Neo.

*Technically, his second return, since he briefly manifested himself in Syntax's first machine liason, DifferenceEngine. He was taken to the Source to be delted. He came back on Recursion too, right at the start of the Unlimit event  And yes! My savior is almost back (although, I know appearences are deceiving :p he's never been too far...) but yay!
